Insurance Disputes:

An additional practice area in which Mr. Morgan is regularly called upon concerns insurance disputes. While many people do not appreciate this, there is a fundamental conflict of interest that exists between insurance companies and their very own insured, in many cases. Oftentimes insured persons naively rely upon their insurance company for advice on how an insurance claim should be resolved. We also see cases in which the insurance company simply delays the resolution of an insurance claim or outright refuses to pay the insured money which the insured is due under the policy. Insurance law can be complicated and insurance companies may make use of that complication to avoid payment.

Condemnation/Eminent Domain:

Anyone who has ever owned a home that was in the path of an intended freeway knows what condemnation and eminent domain is. The government has the ability to take property for public use. However, when the government does so, it is required by our state and federal constitutions to provide fair compensation. In Florida, the procedure for assuring fair compensation allows for a trial by jury if the government and the landowner cannot agree. One helpful rule is that the government also pays the citizens legal fees and costs.
